Can I Form an LLC Online in Delaware?
Yes. Delaware allows complete online LLC formation through the Division of Corporations' eCorp system at https://icis.corp.delaware.gov/eCorp/. File your Certificate of Formation with a $110 fee and receive approval in 2–3 business days under standard processing. Expedited options range from 24 hours (+$50) to 1 hour (+$1,000). Your filing must include your LLC name (with "LLC," "L.L.C.," or "Limited Liability Company"), a Delaware street address for your registered office, and your registered agent's name.
What You Must File
Your Certificate of Formation requires three elements under 6 Del. C. § 18-201:
- LLC name with required designator ("LLC," "L.L.C.," or "Limited Liability Company")
- Delaware street address of your registered office
- Registered agent's name at that address
Your name must be distinguishable on the Division's records. Restricted words—"Bank," "University," "Insurance"—cannot be used (6 Del. C. § 18-102).

Search name availability free at https://icis.corp.delaware.gov/Ecorp/EntitySearch/NameSearch.aspx. If you want to secure your name before filing, reserve it for 120 days for $75.
Any person can organize your LLC—you need not be a member or manager. Delaware permits single-member LLCs and foreign owners.

Submit your Certificate of Formation entirely online through eCorp. Pay the $110 filing fee electronically. Standard processing takes 2–3 business days. If you need faster approval, choose expedited service: 24-hour (+$50), same-day (+$100), 2-hour (+$500), or 1-hour (+$1,000)—all in addition to the base fee. You can select your effective date during filing.
After Formation
If you operate under a name different from your LLC's legal name, file a DBA (Doing Business As) with the county prothonotary in each Delaware county where you conduct business.
