Can I Start an LLC While on a Visa in North Carolina?

Yes. North Carolina permits foreign owners to form an LLC under N.C.G.S. § 57D-2-20. You need one or more persons to execute the Articles of Organization. A visa holder can serve as an organizer or member. The state does not restrict LLC formation based on immigration status—only that you provide a valid name, registered agent, and North Carolina registered office address.

Filing Requirements

File Articles of Organization with the North Carolina Secretary of State, Business Registration Division. Include your name and address as organizer, your LLC name with a required designator (LLC, L.L.C., or Limited Liability Company), a North Carolina registered office street address, and a registered agent name and address. The filing fee is $125.00 for standard processing (10–15 business days) or $100–$200 for expedited service.

File online at https://www.sosnc.gov/online_filing/filing/creation or by mail to PO Box 29622, Raleigh, NC 27626-0622. Search available names first at https://www.sosnc.gov/online_services/search/by_title/search_Business_Registration.

Registered Agent & Address

You must designate a North Carolina registered agent with a physical street address in the state. This can be a professional registered agent service, a North Carolina resident, or a business entity—not a P.O. Box. The registered agent receives legal documents on behalf of your LLC.

Visa Compliance

North Carolina's LLC statute contains no citizenship or visa restrictions. However, federal immigration law may limit business ownership depending on your visa category. Some visas (F-1 student visas) prohibit self-employment; others (L-1, E-2 visas) explicitly permit it. Verify your visa allows LLC formation before filing. Consult an immigration attorney if uncertain.

Next Steps

  1. Confirm your visa permits business ownership.
  2. Search your desired LLC name at the Secretary of State's database.
  3. Prepare Articles of Organization with your name, address, and organizer designation.
  4. File online or by mail with the $125.00 fee.
  5. Obtain an EIN from the IRS.
  6. File a DBA with the Register of Deeds in your operating county if using a different business name.
