How to Get an EIN for Your New Jersey LLC

An EIN is issued by the federal IRS, not New Jersey. After forming your LLC by filing a Certificate of Formation with the New Jersey Department of the Treasury under N.J.S.A. 42:2C-18, apply for an EIN through the IRS at irs.gov, by phone at 1-800-829-4933, or by mail using Form SS-4. Online applications receive your EIN immediately. You'll need your LLC's legal name, formation date, and principal business address.

Form Your LLC First

File a Certificate of Formation with the New Jersey Division of Revenue and Enterprise Services at https://www.njportal.com/DOR/BusinessFormation/Home/Welcome. The filing fee is $125. Standard processing takes 1–5 business days. Your LLC name must include "Limited Liability Company," "LLC," or "L.L.C." and be distinguishable from other active entities under N.J.S.A. 42:2C-8. You cannot apply for an EIN until your LLC is officially formed and approved by the state.

Apply for Your EIN with the IRS

Once you receive your Certificate of Formation approval, apply for an EIN directly with the federal IRS using Form SS-4. The IRS does not issue EINs through New Jersey—this is a federal process only.

Online (fastest): Apply at irs.gov/ein. You receive your EIN immediately.

By phone: Call 1-800-829-4933 during business hours.

By mail or fax: Send Form SS-4 to the IRS address listed on the form. Processing takes up to four weeks.

Information You'll Need

Have your LLC's legal name (exactly as filed on your Certificate of Formation), principal business address in New Jersey, formation date, business activity description, and the number of employees (if applicable) ready when you apply.

After You Receive Your EIN

Your EIN is your federal tax identification number. Use it for federal tax filings, hiring employees, opening a business bank account, and any other federal tax purposes. New Jersey does not track or register EINs—the state only handles LLC formation. Keep your EIN documentation for your records.
