What to Do If Your Name Is Unavailable

If the search shows your preferred name is already taken or reserved, you have two options:

Name Reservation

New Jersey uses a split approach for doing-business-as (DBA) names and alternate names depending on whether your LLC is domestic or foreign.

Domestic LLCs (Formed in New Jersey)

Domestic LLCs cannot file a DBA name in the initial formation filing. Instead, after your LLC is formed and active, you may register an alternate name with DORES. The alternate name registration fee is $50.00, and the renewal fee is also $50.00 per year.

Foreign LLCs (Formed Outside New Jersey)

Sole Proprietors

Sole proprietors follow a different rule: trade names are filed at the county clerk level, not with DORES. If you operate as a sole proprietor using a trade name, you must register it in the county where you conduct business.

Do Not Use a DBA in Your Initial Formation Filing

DORES explicitly warns that domestic New Jersey LLCs should not attempt to register with a DBA name in the certificate of formation.
